KNAPO probation officers election challenged in court

Members of the Kenya National Association of Probation Officers (KNAPO) have moved to court seeking to stop its association from accepting or receiving names of any alleged newly elected officials.

Mercy Kanyangi, Japheth Ruto, Titus Mbaluka, Wilfred Omondi Omollo and Ezekiel Mwirigi are the registered members of the association that have brought the suit in court.

According to the five members, on March 27, an unauthorized person issued a notice inviting the membership of the association to participate in an annual general meeting that was scheduled to take place on April 18.

They say the person usurped the roles meant for the national secretary of the association.

They argue that no statements of accounts and agenda for the meeting have been shared with all the members of the association for scrutiny as provided for in the KNAPO constitution.

Justice Lawrence Mugambi is to issue directions in the case on Wednesday.

When the case was filed on April 16, Mercy and the other four were apprehensive that if the AGM and election of new officials were allowed to proceed on April 18, they would be seriously prejudiced.

They argued that their constitutional right of access to information which in this case are the audited bank statements of the association from 2018 to date.

From their court papers, they seek an order restraining the respondents from scheduling or holding an annual general meeting of the association known as KNAPO or elections of the officials of the association that had been slated for April 18.

Also sought is an order directed to the Registrar of Societies that it should not accept or receive the names of any purported newly elected officials of KNAPO and not register the names of any supposed newly elected officials of the association.
