MP Wamboka: Why I believe CS Linturi broke the law

The Bumula MP cited several incidents to substantiate his claim

Bumula MP Jack Wamboka has told a Parliamentary committee there is sufficient reason to believe Agriculture CS Mithika Linturi committed a crime.

Wamboka, who sponsored an impeachment motion to remove Linturi from office, cited several incidences to demonstrate to MPs that the CS broke the law.

He said the Fertiliser and Animal Foodstuffs Board of Kenya should have been the entity that procured subsidised fertiliser and not the National Cereals and Produce Board (NCPB).

“The fertiliser board and not NCPB should be in charge of procuring subsidised fertiliser. What was so difficult for the CS to appoint this board,” he posed.

Bumula MP was making submissions to the Select Committee on the Proposed Dismissal of Cabinet Secretary for Agriculture and Livestock Mithika Linturi.

Wamboka further faulted the CS for closing down the factory which was alleged to be involved in the manufacturing of fake fertiliser.

Linturi announced that the company’s license had been revoked pending further investigations into the distribution of counterfeit fertiliser to farmers.

“It is not the role of the CS to go to close enterprises of people. He has no role to take away someone’s licence,” Wamboka told the Naomi Waqo-led committee.

Wamboka further accused Linturi of threatening company officials.

“The CS threatened, and we saw the videos. A crook is a person who does not respect the law. If a CS calls you a crook, that is a threat,” he said.

In his impeachment Motion, Wamboka alleges that Linturi is guilty of gross violation of the Constitution by failing to undertake public participation before proceeding with the procurement and distribution of fertiliser.

Wamboka listed three grounds which are alleged to be a gross violation of the Constitution or any other law, serious reasons to believe the CS has committed a crime under national law and gross misconduct.

Linturi has alleged that Aldai MP Maryanne Kitany is the person behind the motion for his dismissal.

Linturi’s lawyer Muthomi Thiankolu told the Select Committee on the proposed dismissal of the Cabinet Secretary that it is Kitany and not Wamboka who is behind his client’s ouster bid.

“The mover of this Motion is the Member for Aldai,” Thiankolu insisted.

Kitany and the Cabinet Secretary were once in a relationship before they parted ways.
