Arrest warrant issued for landlord in murder case after ignoring court summons

Eldoret High Court has issued a warrant for the arrest of a landlord in whose house a 36-year-old woman is said to have stabbed her estranged husband to death in August last year.

Justice Reuben Nyakundi directed Officer Commanding Langas police station to effect the arrest of the landlord after he defied court summons to appear in court to give his evidence regarding the murder incident.

This was after the State Counsel Mark Mugun brought to the attention of the court about failure by the landlord to appear in court to testify in the murder case despite being summoned to do so.

Mugun blamed the landlord for the dragging of the murder case saying that he has been frustrating their efforts to expedite the hearing and conclusion of the murder case since last year.

He implored the Judge to issue a warrant of arrest against the landlord for taking the summons that had been served against him to appear in court for granted.

“The landlord has been summoned on several occasions to appear before this court to give his evidence-in-chief, but he has decided to ignore the summons and I ask the court to issue a warrant for his arrest,” Mugun said.

The woman who is out on bond is accused of killing her husband, Wycliffe Miriti in cold blood at their estate in Eldoret town on the night of August 21 after returning home from a club.

She denied the murder charge when she appeared in court.

She was arrested on the same day after rushing her husband who was in critical condition to the hospital with several knife stabs.

The deceased was a former Senior Logistics officer at an International Beverage company based in Eldoret.

A security officer narrated to the court how he drove to the home of the couple after an alarm was raised by the landlord on the fateful night.

Geoffrey Rono told Justice Nyakundi that from the information gathered at the couple's house; the duo arrived from a local pub at 4.30 am before a fight erupted.

“When we arrived at the couple's house, we met on the way an overspeeding car heading in the opposite direction which we later learned was being driven by the accused who was rushing her husband to the hospital,” he said.

He told the court that they followed the car and found it parked at a private hospital in Eldoret.

While at the hospital, Rono recounted helping the accused to put the deceased in a wheelchair before they were referred to Moi Teaching and Referral Hospital where he succumbed to the knife stab injuries.

Justice Nyakundi directed that the case be mentioned on November 21.
