Herdsman accused of defilement begs court for freedom

A 40-year-old herdsman accused of defiling a 12-year-old girl has fervently pleaded with the Nyahururu law court for his release.

He said he has suffered enough in remand and is an orphan.

William Chesang Chebii who appeared before Chief Magistrate Evans Nezekiah is said to have committed the offence on February 25, 2024 at Ngoru village in Nyahururu Subcounty.

The court assured William Chesang Chebii that his case would be expedited fairly and decision to release him or not be reached once the case is heard and determined.

Particulars of the offence state that on the material day at around 1.00pm the victim met her assailant, an employee of their neighbour while grazing as she was on her way to water cows at a nearby river.

The accused followed the minor, grabbed her hand and dragged her into the nearby bush, threatening to kill her if she screamed before defiling her.

A woman who was passing by caught the accused in the act and screamed before he vanished into the bush.

The girl was escorted home and the matter was reported at Marmanet police station.

She was escorted to a nearby healthcare facility for medical examination as a search for the assailant commenced.

Ephraim Kigunda an investigating officer at Marmanet police station said the accused had gone into hiding at his sister’s place in Tuyapei village in Baringo. 

Police together with the local administration in Tuyapei arrested the accused and took him to Marmanet police station where he was charged.

He was later arraigned in court where he denied the allegations.

The matter is set for further hearing on September 19, 2024.
