Wheels of Justice: Court cases lined up for the day

In Summary
  • The Supreme Court in February this year remitted the case back to the High Court to deal with the contempt of court application.
  • It also set aside a decision that stopped Bia Tosha from having control of 22 beer distribution routes in Nairobi.

Justice Hedwig Ong'undi will give directions in the Bia Tosha case that seeks to have directors of EABL and KBL top directors jailed.

They are cited for contempt for disobeying court orders.

The Supreme Court in February this year remitted the case back to the High Court to deal with the contempt of court application.

It also set aside a decision that stopped Bia Tosha from having control of 22 beer distribution routes in Nairobi.

The Supreme Court judges restored the orders of the High Court that had allowed Bia Tosha to continue distributing products in Namanga, Bissil, Kajiado, Kitengela, Athi River, Industrial Area, South B, Nairobi West, Kenyatta, Lang'ata, Rongai, Kiserian, Magadi, Upper Hill, Ngong Road, Hurlingham, Kawangware, Satellite and Dagoretti.

This order of the High Court was never obeyed prompting Bia Tosha to file contempt proceedings against Kenya Breweries Limited directors.

The apex court in remitting the case back to the High Court said the court should proceed to assess the suitable punishment arising out of the contempt.

Multiple applications have since been filed in the case and the Judge will issue directions in the matter today.

Separately, the court will mention for pretrial a Sh28 million fraud case against Kenyan based Nigerian Pastor Wealth Ochelle Alias Apostle Wealth of Cogic International Church of God domiciled at Shanzu in Mombasa.

Wealth was charged with conspiracy to defraud Stanbic Bank Limited Sh28,779,600.
