Court summons IG and DCI over detention of Sakaja's aide

Justice Mwita had said the two should produce the ex-MCA in Milimani or any other court on November 17.

The Inspector General of Police and the Directorate of Criminal Investigations have been ordered to appear in court on Monday.

They have been summoned to explain why Nairobi Governor Johnson Sakaja's aide Osman Khalif should not be released from captivity.

Justice Chacha Mwita gave the alternative of Koome and Amin's most senior representatives to appear in court on that date if they will not show up themselves.

"I direct the IG or his most senior representative and the DCI or his senior most representative to appear in court on November 20 at 10 am and show cause why Osman should not be released from captivity in compliance with court directions issued earlier,” the justice said.

The directives were issued after Osman's wife through her legal representative said the motor vehicle involved in the alleged abduction is at a police station.

The mall along where the alleged abduction happened or its owners were also directed to supply the court, and Osman's wife with the CCTV footage of November 10 covering the events surrounding Osman's abduction and the movement of the subject motor vehicle.

The Judge also directed Safaricom to supply Osman's wife and her legal team with car parking records of the subject motor vehicle.

This is to be done within the next 24 hours.

The Judge noted that the IG has not in any way attempted to comply with directions he issued on Thursday. 

The Judge in directing they appear in court on Monday said court orders are not in vain and should not be in vain.

The High Court had on Thursday ordered the Attorney General and the Director of Public Prosecutions to produce Khalif Abdi in court following his alleged abduction on November 10.

Justice Chacha Mwita said the two should produce the former South C MCA Osman in Milimani or any other court on 17 November.

If not, they should "show cause why the said Osman should not be released"
