Court extends orders barring Bomas CEO suspension as Judge quits case

Gitaa was suspended following a recommendation by EACC.

A judge has disqualified herself from hearing and determining a dispute involving the employment of Bomas of Kenya CEO.

Employment and Labour Relations Judge Ann Mwaure bowed out of the case due to personal reasons.

"This court does not wish to proceed with this hearing for personal reasons and in any event the Judge will be proceedings on leave and that might cause delay in determining the case," said Mwaure.

She directed the matter be placed before the principal judge Byrum Ongaya on February 13 to allocate the same to a Judge that will determine the case.

She at the same time dismissed an objection raised by the Bomas of Kenya which argued the court has no jurisdiction over the case.

She said the matter having raised out of employer and employee grounds is at the right forum.

She subsequently extended orders blocking the Bomas of Kenya board from appointing an acting CEO to replace Peter Gitaa.

Gitaa was suspended following a recommendation by the Ethics and Anti-Corruption Commission (EACC)

His lawyer Danstan Omari argued that the recommendation by the EACC was marred by irregularities and procedural flaws.
