Kitui chief charged over assault claims

A chief in Kitui county was on Monday charged in a Kyuso court with allegedly beating up and causing bodily harm to a woman last Friday.

Usueni chief Daniel Mwendwa Muli was accused of assaulting Jerusa Muthoni, who is a neighbour, on January 12 at around 9.30am in Usueni village.

Useuni is in Tseikuru subcounty, Kitui county.

The accused, who was unrepresented, denied the charges before Kyuso resident magistrate Anne Lule.

State counsel Brain Kipkurui opposed Muli's release on bail.

He argued that being a chief, the accused wielded a lot of influence and was likely to interfere with witnesses.

Kipkurui, however, said should the court find it ideal to release Muli on bail, then the accused must be cautioned against interfering with the prosecution witnesses.

Muli defended himself saying he is not only an honest and law-abiding citizen, but also a God-fearing pastor of a church in Usueni.

He said he will not interfere with witnesses.

He asked the magistrate to release him on Sh5,000 bail, saying “my payslip is running at only Sh17,000”.

He promised to attend all hearings as directed by the court.

The court granted Muli’s request and released him on Sh5,000 bail.

The case will be mentioned on January 22, when the hearing date will be set.

Muli, who was sporting a sling on his left hand, complained that police in Tseikuru did not give him a P3 Form, saying he was also assaulted.

He claimed he suffered a fracture after he was hit with a stone by the complainant and police declined to investigate his complaint.

The magistrate ordered the officer investigating, Inspector Joseph Muthui to appear before her on Tuesday to clarify whether the issues being raised by the accused were true.
