A 35-year-old man who was found guilty of having defiled a 13-year-old minor after luring her with mandazis has been sentenced to 20 years’ imprisonment by a Loitoktok court.

The accused Johanne Ntete committed the offence on August 12, 2023, at around 6pm at Rombo Trading Centre.

He lured the girl from her home after promising her she would be his wife, then led her to a nearby gulley where he defiled her.

During the trial before Principal Magistrate Judicaster Nthuku, a neighbour, Purity Maina, told the court that she alerted the girl’s mother Susan Waithira when she saw the accused while accompanied by the minor headed towards the gulley.

The minor’s mother, her son, and some neighbours proceeded to the gulley and found the accused lying on top of the girl with his shorts and shuka beside them.

Ntete was apprehended after he tried to run away and police officers from Rombo police station were called in and escorted him to the police station.

The girl was taken to a local health centre for medical examination where it was confirmed that she had been defiled.

In defence, the accused denied defiling the girl and explained that the group that arrested him found him at home and started beating him before taking him to the police station.

However, Principal Magistrate Judicaster Nthuku dismissed his defence contending that the various independent witnesses couldn't have all conspired against him.

The court ruled that the prosecution had proved the case beyond reasonable doubt hence the sentence.

The accused was granted 14 days within which to appeal against the sentence as provided in law.
