Court certifies Lavington land dispute as urgent

A Milimani Law Court has certified a Land dispute case in Lavington as urgent and directed that the application to be served for inter parties hearings on September 30.

Environment and Land Court Judge A.Omollo made the ruling after Ayaga Sangale moved to court to protest an ongoing excavation activity next to his land in Lavington.

In the case, Makao Fahari Company has been listed as a respondent.

Symolink Company Limited has also sued the company with similar claims.

They are neighbours where the alleged construction is taking place.

Sankale and Symolink had sought orders that the construction be stopped pending a hearing and determination of the suit.

In Sankale's application, he is apprehensive that the alleged construction of 270 units next to his plot will affect his matrimonial home and another neighbouring apartment.

He claims it is not in doubt that existing buildings will collapse adding several national disasters that have occurred as a result of dangerous excavations.

The Judge however declined to issue interim orders stopping the construction.
