The Kenya Ports Authority yesterday told a Mombasa court that Danson Mungatana is a witness in a case in which 136 workers are accused of forging certificates.
KPA’s lawyer Paul Munyao said it is unconstitutional for Mungatana to represent the workers since he was the KPA chairman when the matter arose.
“There’s a clear case of conflict of interest. Mungatana cannot act for the workers since he has chaired most of the meetings when he was KPA’s chairman,” he said.
The employees moved to the Industrial Court seeking to stop their sacking.
They want KPA held accountable for the mess.
The employees include25 managers who allegedly secured employment using fictitious academic and professional certificates
Mungatana defended his clients saying they had a right to be represented by a lawyer of their choice.
He also denied chairing any meetings.
Mungatana said KPA will not suffer any prejudice if the employees are allowed to continue working. Justice James Rika set the ruling for September 15.
