The Lamu Law Court has sentenced a 46-year-old man to 10 years imprisonment for sexual assault.
Mamoud Abdalla Mahmoud alias Ramba-Ramba was found guilty of sexually assaulting a 13-year-old girl contrary to section 5(1)(a)(i)(2) of the sexual offenses act No 3 of 2006.
The particulars were that on June 29, 2023, at about 6 pm at Pate village in Lamu East subcounty, Mamoud, intentionally and unlawfully sexually assaulted the girl.
Mahmoud also faced an alternative charge of committing an indecent act with a child contrary to section 11(1) of the sexual offenses act No.3 of 2006.
The court heard that Mahmoud intentionally and unlawfully touched the minor’s private part inappropriately.
In his defense, he claimed that he loves the girl so much and asked to be released promising to pay her school fees for the girl until she clears primary school and then marry her.
The grandmother of the minor, in her testimony confirmed that the girl had just turned 13.
While delivering the judgement, Lamu Courts Senior Principal Magistrate Allan Temba ruled that Mahmoud is a dangerous sexual offender and sentenced him.
Mahmoud has been given 14 days to file an appeal.
The ruling comes just days after the same court sentenced a Kenya Wildlife Service (KWS) ranger to 15 years imprisonment for defilement.
Ayub Kamau, alias Osman, a ranger who was stationed at Kiunga KWS camp in Lamu East subcounty was on Monday found guilty of defiling the 15-year-old girl.
Kamau was also sentenced to 10 years in jail.
