Kidero seeks election material to challenge Wanga's win

He wants copies of forms 34, 35, 36, 37, 38 and 39 A, B and Cs from all polling stations and tallying centres in Homa Bay

Former Nairobi Governor Evans Kidero has written to the Independent Electoral and Boundaries Commission to furnish him with some information to enable him to file a petition challenging Gladys Wanga's win.

Through Okweh Achiando and company advocates, Kidero wants IEBC to provide him with data on how the election was conducted.

The law firm wants to use the information as supportive evidence.

In his 11 points demand, Achiando wrote to the CEO Hussein Marjan, seeking copies of forms 34, 35, 36, 37, 38 and 39 A, B and Cs obtained from all polling stations and tallying centres in Homa Bay.

Wanga has already been sworn in as the second governor of Homa Bay.

“Avail the audit logs of all KIEMS kits transmitted from the polling stations to the tallying centres during the poll conducted in Homa Bay,” the letter reads.

Kidero wants the commission to provide him with the static IP address of each KIEMS kit used.

IEBC should also give Kidero specific GPRS locations of each of the electoral gadgets between August 8 and August 11 and all SD cards used in the exercise.

“There is a need to provide a count of the number of voters identified by each machine used in the poll as well as the number of voters identified alphanumerically and the number of voters identified manually,” the letter reads.

This is alongside copies of manual registers used during the poll and poll diaries used on August 9.

In the letter copied to the county returning officer Fredrick Apopa, Kidero wants his demands to be met within seven days to enable him fastrack his petition.

He promised to pay reasonable charges upon notification.

Apopa declared Wanga as the winner with 244,559 votes against Kidero who got 154,182 votes while UDA’s Mark Rabudi got 1244 votes to emerge third. 

“Should we fail to get the documents or information within the time presided above, we shall take further legal action as we shall deem fit and appropriate,” he said.

In the race, Kidero ran as an Independent candidate while Wanga contested the seat on an ODM ticket.
