Gachagua wants Orengo barred from acting for National Assembly

Njiru said it would be prejudicial to Gachagua if the House allowed Orengo to represent the National Assembly.

Deputy President Rigathi Gachagua has raised an objection to the appearance of Siaya Governor James Orengo as part of the legal team for the National Assembly.

Through his lawyer Ndegwa Njiru, Gachagua argued that Orengo is a full-time serving state officer and thus should be barred.

He noted that as per Article 260 of the constitution as read together section 26 (2) of the Leadership and Integrity Act bars a full-time state officer from engaging in gainful employment.

"We are raising an objection to the appearance of my senior advocate James Orengo to represent the National Assembly in this proceedings," Njiru said.

"James Orengo is a full-time serving state officer and article 260 of the constitution and leadership and integrity act that bars state officers from other gaining employment," he added.

Njiru said it would be prejudicial to Gachagua if the House was to allow Orengo to represent the National Assembly.

He cited the Senate's decision to bar Sylvanus Osoro, National Assembly Majority whip, from representing Kisii County Assembly in the impeachment of former Governor Robert Monda.

He also cited several court decisions barring state officers from engaging in other gainful employment.

"It will raise serious conflict of interest and will prejudice our client. We plead with you to uphold our objection before the charges are read out to our client," he said.

Orengo, a senior counsel, has been listed as the lead counsel for the National Assembly.

Other counsels for the court Assembly are Paul Nyamodi, Eric Gumbo, Moses Kipkemoi, Muthomi Thiankolu, Peter Wanyama, Kenny Kipkoech and Joan Cheruto. Others are Erick Mwangi, Bonface Mawira, Kevine Otieno and John Mwangi.

However, Speaker Amason Kingi has ordered the DP to plead to the 11 charges facing him before he invites the National Assembly to comment on the objection.

Thereafter, he shall give a ruling on the matter.
