Nyali MP asks Speaker Muturi to amend decision to impeach CS Macharia

Claims that evidence supporting his motion could have been "left out"

Nyali MP Mohamed Ali has readdressed the office of the National Assembly Speaker Justin Muturi over the motion seeking to impeach Transport Cabinet Secretary James Macharia.

This comes hours after the Speaker dismissed his motion on grounds that it did not meet the threshold hence not admissible.

In his ruling, Muturi said that the legislator did not provide evidence to the allegations against the CS.

"It is, therefore, my determination that the proposed motion is not admissible," Muturi said.

The MP has claimed that crucial evidence supporting his motion could have been "left out" despite following due procedures as directed by Clerks to the Speaker.

“Despite following due process as advised by the Clerks to the Speaker, they seem to have 'left out' that evidence was necessary at submission… I have written to him to amend his decision and attached all the necessary evidence,” Ali said.

In his bid to have the CS removed in his office, Ali said he has produced more evidence to support his motion, including illegal Port Contract and the names of beneficiaries.

Ali said he has evidence of illegally acquired land belonging to the farmers which were sold to Kedong Ranch Limited, where Naivasha Inland Container Depot sits on.The MP has further added that he will table more evidence to boost his motion.

Ali had given the notice to table a motion seeking to remove Transport CS James Macharia from office over his order to use the SGR to transport cargo from Mombasa to Naivasha Inland Container Depot.

The legislator, in the notice dated June 6, said that the CS violated Article 10(1) (c) of the Constitution by not undertaking public participation with leaders and stakeholders.

 

He said the CS's action has caused a public outcry and has affected the transportation sector negatively, forcing some companies to shut down.
