Here's what would happen if DP Ruto resigned

The president shall within 14 days after the vacancy arises nominate a person to fill the vacancy

Kenyans have been wondering what would happen if Deputy President William Ruto resigned from the government.

This follows a widening of the rift between the DP and his boss, President Uhuru Kenyatta.

In previous interviews, the second in command lamented that Uhuru assigned his duties to Interior Cabinet Secretary Fred Matiang'i but insisted he is in government to stay because he was constitutionally elected alongside the president.

On Monday, Uhuru in an interview on Citizen TV, took a swipe at the DP, daring him to quit instead of attacking the government from within.

"The honourable thing is that if you are not happy with it, step aside and allow those who want to move on to do so and take your agenda to the people," Uhuru said.

He added, "I would hope that people would have the courage to do that instead of throwing stones in the same house that you live in."

In the interview, Uhuru said he is not aware of why DP Ruto's side had chosen the attacks, but the machinations wouldn't derail him from the agendas of his administration.

Article 149 of the Constitution of Kenya gives guidelines on what happens when a vacancy arises in the office of the Deputy President.

The president shall within 14 days after the vacancy arises nominate a person to fill the vacancy and the National Assembly shall within 60 days after receiving the nomination vote on it.

If approved, the person shall become Deputy President and will be deemed to have served a full term if at the time of assuming office more than two-and-a-half years remain to the date of the next General Election.

The person will not have served a full term in any other circumstances.

Other than resignation, the deputy president may be removed from office on the ground of physical or mental incapacity to perform the functions of the office, impeachment or death.
