Kianjokoma brothers case: Cops' plea taking deferred as lawyers withdraw

Plea-taking for the six cops linked to the death of two brothers from Kianjokoma, Embu county, has been deferred.

This is after the lawyers representing them withdrew from the case.

The officers are Benson Mputhia, Consolata Kariuki, Nicholas Cheruyoit, Martin Wanyama, Lilian Chemuna and James Mwaniki.

Justice Daniel Ogembo on Tuesday said it was important that the suspects are represented and in this case the lawyers have withdrawn.

"So I will allow this request by the suspects to get new lawyers. I will not allow them to be remanded at Industrial Area because it will make it hard for them to get advocates," he said.

He has directed that the deputy registrar allocates them state lawyers on Wednesday and they will take plea on Thursday.

Judge Ogembo said each will be given a lawyer but if they get their own they are also free to join the court.

The suspects will be remanded at Capitol Hill police station.

Earlier, only five cops turned up in court after one of the police officers was said to be unwell.

Through one of their lawyers, Danstan Omari - who has since withdrawn - the court was informed that one of them - Kariuki, the second accused - was unwell.

The matter was before Magistrate David Ndungi who remanded them two weeks ago.

Omari wanted the matter to be mentioned before Ndungi for the file to be closed before the cops were formally charged

However, the prosecution had already registered the charge sheet for murder before the High Court.

LSK President Nelson Havi had said the five should take plea because the mental assessment declared them fit to stand trial.

Havi had argued that the state sought for 14 days which lapses on Tuesday so they should plead to the charge.
