The High Court has declined to stop the swearing-in of four IEBC commissioners appointed by President Uhuru Kenyatta in a Gazette notice.
They are Juliana Cherera, Francis Mathenge, Irene Masit and Justus Abonyo.
Justice Weldon Korir on Thursday said the country is heading towards elections and any further delay of swearing-in will be dangerous.
"It's in the public interest that the conservatory orders should not be granted" court ruled.
Justice Korir said this is the period that IEBC should be busy.
The commissioners are expected to serve for six years.
Last month, the Court of Appeal ruled that the commission was not properly constituted, hence had no capacity to make major decisions such as involving a General Election.
Following their latest appointments, the IEBC is now duly constituted.
The commissioners replace Roselyn Akombe, Margaret Mwachanya, Paul Kurgat, and former vice-chair Consolata Maina who resigned from the commission in 2017 and 2018 respectively.
