The murder trial of Joseph Irungu alias Jowie and Jacque Maribe was adjourned over Prof Hassan Nandwa’s poor health after he was abducted two week ago.
Nandwa, who is Jowie’s lawyer in the case, was found in Mwingi where he had been dumped by the abductees.
The trial was supposed to proceed but Justice Grace Nzioka took out all the dates that had been allocated in the matter due to Nandwa’s ill health
The court was informed that the lawyer was indisposed due the trauma that he had undergone and was still unwell so he could not proceed with the matter.
The case was adjourned to December 2 when the court will issue directions on when to proceed with the hearing after the court is updated on Nandwa’s health status.
Nandwa was found alive in Mwingi on Monday last week at 1am and later reunited with his family.
It is not clear who was behind his abduction and where he was during that time.
However, his client and ex- terror convict Elgiva Bwire is yet to be found.
The two went missing on October 28 after Bwire was released from prison.
LSK had asked the court to order the IG to produce both Bwire and Nandwa in court.
The court allowed their application and ordered the state to produce the two in court within 24 hours.
LSK had argued that IG and Safaricom are also in possession of mobile phone call log and messaging data, and they can use these tools to assist in tracing Nandwa and Bwire.
Nandwa in his capacity as an advocate represented Bwire who was released from Kamiti Maximum Prison on October 28.
Bwire was handed over to his mother in the presence of Nandwa by the Anti-Terrorism Police Unit officers.
The court documents indicate that Nandwa on October 28, reported at Nairobi Central police station the abduction of his client-Bwire.
Between 11pm and midnight, nine armed men who identified themselves as police officers stormed the residence of Nandwa. They indicated they were looking for Bwire.
“We are apprehensive that the lives of one of our members and his client are in peril at the hands of officers of the Inspector General of Police since the storming of his residence by armed police officers.”
LSK said the armed police officers and the IG are aware of the whereabouts of the two.
