The Court has granted Turkana Governor Jeremiah Lomorukai an anticipatory bail of Sh20,000.
A directive issued by Eldoret High Court judge Justice Eric Ogola said the application was to be served for a hearing between the applicant and the respondents on Thursday, October 27.
"It is hereby ordered that the applicant (Lomorukai) is hereby admitted to anticipatory bail pending of Sh20,000," Judge Ogola said.
An anticipatory bail is given as an order to release one on bail in the event of arrest.
The order was issued on Tuesday after a Certificate of Urgency was filed before the court by the Governor's lawyer Tom Ojienda.
This followed a communication by EACC CEO Twalib Mbarak that the Governor had allegedly forged his academic credentials.
EACC claimed Lomorukai forged his degree and diploma certificates purporting they were issued to him by the Kenya Methodist University (KEMU).
The Commission said the action rendered him liable to criminal prosecution.
"The matter is extremely urgent acquiring to be placed before the Honorable Judge and be heard expeditiously as the applicant is apprehensive that he is likely to be arrested after the EACC shared his name to the leading national TV channel for the news bulletin on Friday, September 23 at 7 pm and 9 pm broadcast that his arrest was impending," the certificate read.
Ojienda argued that there was no formal communication to the Governor to present himself to the police station.
He added that the university had not revoked any certificates belonging to the Governor.
He said a similar case had been filed before High Court's Lady Justice Hedwig Ongudi, to bar Lomorukai from contesting.
The Senior Counsel further said following the media reports, the Governor formally wrote to the EACCC and ODPP explaining the position of the case to no avail.
The Certificate was filed on October 11.
