What next after Duale, Murkomen, Wahome resignations?

The Speakers of the National Assembly and the Senate will be expected to declare vacancies in three areas following the resignation of their elected leaders.

Elgeyo Marakwet County, Garissa Town and Kandara constituencies have been left bare after their leaders quit office to take up Cabinet roles.

 

CS for Transport Kipchumba Murkomen, CS for Water Alice Wahome and CS for Defence, Aden Duale were Thursday sworn into office after tendering their resignation on Wednesday.

Murkomen had elected Elgeyo Marakwet Senator before he resigned while Wahome had won a second term as Kandara MP.

Duale was to serve his fourth term as Garissa Town MP before he resigned.

According to the Kenyan constitution, the office of a member of Parliament becomes vacant if the member dies, is removed from office or resigns from Parliament in writing to the Speaker

 The three tendered their resignations to the two Houses of Parliament ( Senate and National Assembly ) on Wednesday afternoon after the MPs approved the entire list of Cabinet nominees.

The three have been President Ruto’s lieutenants since 2013, leaving the Jubilee party together to form the United Democratic Alliance.

It is expected that speakers from both houses have to officially notify the electoral agency, IEBC, of vacancies in the respective areas.

It is under the Election Act 2011 that the speaker is required to give the Independent Electoral and Boundaries Commission (IEBC) a written notice of the vacancy within a period of 21 days from the date the seats fell vacant.

IEBC will then, within 21 days, gazette the by-election in a notice that will indicate when residents of a given area will elect their new leaders.
