Lawyer Danstan Omari speaks to the media outside DCI headquarters on Kiambu road, February 21, 2023.

Lawyer Danstan Omari has disclosed why the Kenya Kwanza government is coming for him.

While speaking about the summons by the Directorate of Criminal Investigations, Omari said it was because he is representing the disbanded Special Service Unit (SSU) officers.

He said that when President William Ruto's government came into power, a narrative had been created during campaigns that the SSU was a 'killer squad' within the police service.

When they got arrested, he said no lawyer wanted to represent them except for him.

"Let me tell you the real reason these guys are after me. When the Kenya Kwanza government came to power, there was a narrative that the police were killers... They were arrested and no advocate appeared. I stood firm defending the police," Omari said on Wednesday, on TV47.

He noted that when the current administration leaves power, most of the cases against the officers will be dropped, and this will be proof enough that there was state interference.

"For the record, I have more than 500 files where I'm defending the police. So it is quite musical and I've told them after they lose power all those cases will be dropped and what will be the answer? there was interference by politics to the DCI to arrest," he added.

He also termed the summon against him by the DCI over the alleged raid on former Interior CS Fred Matiang'i's home, a political witch-hunt.

He also questioned why Azimio leader Raila Odinga who was with him at Matiang'i's home had not been summoned.

Omari said to date, the DCI has not reached out to his client (Matiang'i) for a statement on the alleged raid.

"Whether the raid was there or not, advocates are called on distress. These people have never gone to visit my client and take a statement from the CS. They have not summoned Raila Odinga who we were there with. Why don't they summon Raila Odinga," he said.

On Wednesday, however, the high court suspended the summons issued by the DCI.

Justice Jairus Ngaah certified the matter as urgent and issued a stay of the summons issued by the DCI and further granted him leave to file a substantive application.

Justice Ngaah has directed him to file the substantive motion within seven days and serve it to the respondents.

The case shall be mentioned on March 8 for further directions.
