Bungoma High Court on Tuesday upheld the election of Webuye West MP Dan Wanyama.

While delivering the verdict, Justice Musyoka Makau said the evidence presented did not support the fraud claims.

He ordered the petitioner, Kelly Walubengo, to pay Sh5 million in costs.

Walubengo had accused the third term lawmaker of electoral malpractice in the August 9 election.

He cited nine grounds on which he wanted the election outcome reviewed, including violence, ballot stuffing and mismatch in numbers reported voters to those captured in the KIMS kits.

Wanyama was declared winner in the 2022 polls with 14,325 votes against Walubengo's 12,005 votes.
