We didn't enter into plea agreement with Mackenzie, DPP clarifies

Mackenzie pleaded guilty to the offence of offering Basic Education in an unregistered institution.

The Office of the Directorate of Public Prosecution has clarified they did not enter into a plea agreement with controversial Pastor Paul Mackenzie.

ODPP was referring to a statement issued by the Directorate of Public Affairs and Communication of the Judiciary on April 27.

ODPP said Mackenzie was subsequently acquitted pursuant to Section 215 of the Criminal Procedure Code.

"The Office of the Director of Public Prosecutions wishes to clarify that the Office did not enter into a Plea Agreement with Paul Mackenzie and that the accused was placed on his defence and subsequently, in the Malindi Criminal Case No. 790 of 2017," the statement read.

It stated that on March 15, 2017, Paul Mackenzie, Winnie Alexander Gandi and Betty Mwaka were charged jointly with the offence of offering Basic Education in an unregistered institution.

The charge attracted a maximum penalty of Sh200,000 or a term of imprisonment not exceeding 12 months, or both.

The accused was fined Sh20,000 and paid vide receipt no. 3500206 dated March 23, 2017.

The ODPP further clarified that in Malindi Criminal Case No. 790, where Mackenzie was charged with the offence of radicalization.

ODPP said the accused was acquitted under Section 215 of the Criminal Procedure Code.
