The Political Parties Dispute Tribunal has stayed Jubilee party's Internal Dispute Resolution Committee's decision to dismiss retired President Uhuru Kenyatta's special National Delegates Convention held on May 22.
In her ruling, PPDT chairperson Desma Nungo said any other decision made after the dispute committee's directive also stands suspended.
"It is hereby ordered that pending hearing and determination of the Application inter partes, interim conservatory orders are hereby issued staying the 1st Respondent's decision dated 30th May 2023 including any decisions, actions, resolutions or pronouncements taken pursuant thereto," the order reads.
The petition was filed by embattled Jubilee secretary general Jeremiah Kioni.
The party’s internal disputes resolution committee had declared null and void the special NDC that was convened by Uhuru at Ngong Racecourse to reinstate order in the party.
The party's internal dispute arbiter declared that the party leader, who summoned the SNDC, erred as he failed to comply with the provisions of the former ruling party's Constitution.
"The purported SNDC held on May 22, 2023 was convened in contravention of the party Constitution and was therefore also null and void,” the committee chaired by Gideon Solonka ruled.
The ruling came even as the Registrar of Political Parties, Ann Nderitu, declined to effect the removal of several renegades purged during the SNDC.
Nderitu, in a letter to besieged secretary general Jeremiah Kioni, said the party submitted incomplete documents to her office to authenticate the ouster of members of the splinter group led by EALA MP Kanini Kega.
"Following a review of the submitted documents, this office is unable to address the substance of the resolutions for non-submission of requisite documents," Nderitu said in a letter to Kioni.
The said documents that Kioni failed to submit include a duly signed list of attendance with ID numbers to ascertain composition of the NDC and quorum in line with the party Constitution.
Kioni's faction also failed to provide detailed minutes of the NDC meeting to determine the process and mode of election as only an extract of the minutes was submitted.
During the SNDC held at the Ngong Racecourse in Nairobi on May 22, Uhuru kicked out rebels, including Kega, Sabina Chege, former MPs Jimmy Angwenyi, Naomi Shaban, Peter Mositet and Gatobu Kinoti among others.
Others shown the door were Rachael Nyamai, Adan Keynan, Joshua Kutuny and Mutava Musyimi. The lot has shifted their allegiance to President Ruto.
