The hearing of the defamation case against Kikuyu MP Kimani Ichung'wah was on Monday adjourned to next week to allow parties to file and serve responses.

In the case, city lawyer Danstan Omari has sued the legislator seeking Sh11 million in damages claiming Ichung'wah tweeted that he frequents the infamous Koinange Street.

Magistrate Caroline Kemei directed the matter to be mentioned on July 5 after both parties have complied with court directions.

The case was coming up for hearing but the court was informed by Omari’s legal team that Ichung'wa has not responded to their application

However, Ichung'wah’s lawyers said they had filed a defence and a counterclaim on Monday morning and undertook to serve Omari with the pleadings.

The court gave Ichung'wah seven days to file his response to the application and Omari was granted three days to file a further affidavit.

Omari made good his threat in April to sue the legislator for tweeting that he is known along the infamous Koinange Street.

The advocate had written a demand letter to Ichung'wah giving him seven days to retract and apologise but he refused.

In his petition to the court, Omari wants Ichung'wah to pay Sh11 million in damages for both general and aggravated damages he has suffered as a result of that tweet.
