Omtatah warns EPRA against defying court order on Finance Act

He said he will go after any individual, body or institution that will go against the order.

Busia Senator Okiya Omtatah has sent a warning to the Energy and Petroleum Regulatory Authority (EPRA) against defying court orders on Finance Act 2023.

This is after the High Court stopped the implementation of the Finance Act following a petition filed by Omtatah and others.

Omtatah said he will go after any individual, body or institution that will go against the order.

“The second order, the court says thou shall not do anything about that bill to impose it on Kenyans,” Omtatah said.

“That will be an order EPRA needs to take seriously because if they don’t we shall be after them.”

He said the Authority is very much aware of the issued order and they should not act contrary against it.

“They have ample knowledge that the court has issued orders, it’s in the media and all over. It will not have any defence against that order. So I hope that EPRA will obey that order,” Omtatah said.

Omtatah had moved to court seeking the implementation to be halted arguing that the Act is unconstitutional.

He said the Finance Act contains amendments to several laws that have nothing to do with raising revenue and laws that affect the work of the Senate to protect the interests of counties and their governments.

However, on Friday, EPRA increased fuel prices with Petrol retailing at 13.49, Diesel at Sh12.39 and Kerosene at Sh11.96 in Nairobi.

The matters will be mentioned on July 5 for further directions.
