Defence CS Aden Duale has hit out at National Assembly Minority Leader Opiyo Wandayi following his signing of the Azimio petition against the Kenya Kwanza administration.
Duale said the Ugunja MP ought to resign for ignoring a provision of the Constitution on the delegation of sovereign power, hence denying the existence of the Parliament.
"My leader, then you are saying that you are negating Article 1(3) of the constitution, hence Denying the existence of the legislature as an arm of government," he tweeted on Tuesday.
"Hypocrisy and deceit were not in your DNA? What happened? Resign."
Article 1(3) states that;
"Sovereign power under this Constitution is delegated to the following State organs, which shall perform their functions in accordance with this Constitution (a) Parliament and the legislative assemblies in the county governments; (b) the national executive and the executive structures in the county governments; and (c) the Judiciary and independent tribunals."
In a statement after participating in the drive towards 10 million signatures, Wandayi said he had officially assented to exercising his sovereign power.
"I have given my formal consent to exercise my sovereign power directly and not through any person, not a representative or any delegated authority," he tweeted.
"Therefore, through my digital signature, I fully support the citizens’ initiative to declare a vote of no confidence in the Kenya Kwanza government."
Opposition leader Raila Odinga hopes to attain the signatures in a bid to remove President William Ruto from office.
The ousting of a president is however the role of the National Assembly, under either of two grounds.
They include impeachment or incapacity.
