Activist Boniface Mwangi has threatened to take legal action against the chairperson of the President's Council of Economic Advisers David Ndii for defamation.
It followed Ndii's claims that he paid Mwangi to be part of the conveners of the Linda Katiba, a citizen's voluntary initiative that is determined to resist government-led move to unconstitutionally cannibalise and overthrow the will of the people.
"I volunteered my time and resources to Linda Katiba. I did not ask anyone for money. I was not paid anything by anyone including William Ruto. If Ndii is ready to stand by his lies, then we will meet in court and we will see if he has the evidence to support his lies," Mwangi said.
Ndii on Sunday evening alleged via a tweet that the activist was paid to be part of the initiative.
"Time for revelations. Linda Katiba was formed by myself and Martha with Ruto's support. Martha was then prospect for WSR running mate. Made full disclosure which is why Makau Mutua was attacking me. Even paid Boniface from WSR campaign money. Hypocrites the whole lot," he said.
But through James Njeri and Co Advocates, Mwangi has demanded that Ndii deletes the offending tweet and issues a written unconditional apology besides admitting liability for damage caused on his reputation.
He further wants Ndii not to publish or utter any further defamatory words against him.
"Your tweet has subjected our client to online bullying and attacks from trolls causing him great distress and irreparable damage to his hard-earned reputation as a bastion of society against injustice," the demand letter to Ndii reads in part.
"Take notice that unless we receive your admission of liability within seven days, we have mandatory instructions to pursue legal proceedings against you for defamation."
The lawyers told Ndii that his tweet is still up despite Narc Kenya leader Martha Karua having set the record straight concerning the funding allegations.
Karua had in her response to the allegations rubbished Ndii's account of events saying no one funded the initiative
"I am disappointed you have joined the ranks of unmitigated liars. Throughout our collaboration with Linda Katiba, you never disclosed of any funding from William Ruto or anybody else. We contributed to our expenses until the end when we secured funding from a philanthropist. If at all William Ruto funded you it was your own private affair," she tweeted.
"I am not aware of Boniface Mwangi being paid from William Ruto's money. I recall by the time Boniface Mwangi left we were not able to refund him out-of-pocket expenses let alone remunerate him."
Karua further said that Ndii disclosed to her that he had received financial support from Ruto for his case against the BBI but she was not party to the case and "you were already in court when I joined Linda Katiba".
Mwangi termed Ndii's tweet as offensive and a lie saying his support for Linda Katiba was "a patriotic duty together with other fellow Kenyans."
