Ex-cop Linda Okello awarded Sh6.5m in libel case

Court said payout includes costs of the suit in case against a local paper.

Former police officer Linda Okello has been awarded Sh6.5 million in damages for improper use of her image by a local publication.

The former police officer filed the civil case at the High Court in Nairobi in 2014.

"Judgment be and is hereby entered in favour of the plaintiff against the defendants jointly and severally in the sum of Sh6,500,000 together with costs of this suit and interests at court rates from the date of this judgment until payment in full," Justice Asenath Ongeri said.

In the ruling delivered virtually on August 17, Justice Ongeri further issued a mandatory injunction for the defendants in the case to publish an apology.

The court also issued a permanent order against the defendants for carrying any publication using words or innuendo deemed libellous to the plaintiff. 

"A permanent injunction be and is hereby granted against the defendants whether by themselves, their agents and/or employees by publishing the defamatory words by innuendo similar in effect and/or substitute to the plaintiff."

Okello was represented in the case by a lawyer and Kisumu Senator Tom Ojienda.

"We have just won an award of 6.5 Million for Linda Okello a former police officer improperly degraded by the improper sharing of her image and likeness and the use of her image for commercial gain and or publicity," he said in a statement on Twitter Wednesday evening.
