Baby abandoned at birth adopted after court approval

Judge Mshila approved the baby's legal adoption to PKM (35) and FWK (32).

On April 1, 2021, Baby GU was born and abandoned in Thika Level 5 Hospital.

The case was reported to Thika Police Station but efforts to locate the baby's mother proved fruitless.

When the matter was reported to the court, it was urged to dispense with her consent - This is a legal process where biological parents are deprived of such rights and their consent is not required to proceed with an adoption.

The baby would then be admitted to Macheo Children's Home for temporary shelter, care and protection awaiting committal to the home.

This came by the end of the month on April 30,201, when Baby GU was formally committed to the institution. 

Come November 24, 2021, Baby GU was declared for adoption which was followed by the issuance of a certificate by the Kenya Children's Home Adoption Agency.

Now Baby GU, who is three years old, has found a family to belong to.

The court on August 18, 2023, approved couple code-named PKM and FWK to have the legal parentage to GU, who will be renamed JMK.

PKM (35) and FWK(32) were married on June 9, 2021, and have no children of their own. 

Apart from their ages falling within the prescribed legal parameters, the two were found to be financially capable.

P is an insurance agent and also engages in business and F is a businesswoman and is engaged in running a shop.

"They tendered into court copies of title documents and bank statements to prove their financial capability to support Baby GU when they assume responsibility for his upbringing," the court paper reads. 

The law requires that an adoptive parent be in the age bracket of not less than 25 and not more than 65 years old. 

"This court is satisfied that the applicants (PKM and FWK) have fulfilled all the pre-requisites for adoption orders and are found to be suitable persons to adopt BABY GU and it is further satisfied that the order for adoption will be in the best interest of the baby," Judge Abigail Mshila said. 

She directed the Registrar General to enter JMK's adoption order in the Adopted Children's Register.

Further, the court directed that the Registrar of Births and Deaths issue a Certificate of Birth in the name of JMK.

A person code-named CM was appointed as Baby JMK's legal guardian and others referred to as INK and JW were appointed as next of kin and also legal guardians to the baby.

This is until the minor attains the age of majority.
