A Nairobi-based court has barred nominated Senator Gloria Orwoba and bloggers from making or posting any further defamatory statement against Senate Clerk Jeremiah Nyegenye.
Milimani Commercial magistrate Ruguru Ngotho issued the temporary orders and certified the application by the Clerk as urgent.
“Pending the hearing of this application, an order is granted restraining the defendant, Abuga Makori on X (formerly Twitter), Lightcast TV Kenya on Facebook and Amakanji Thomas from publishing or reposting any publication against Jeremiah as a sexual predator,” the order states.
The magistrate said they should not post any video clip or post anything online or in print media that defames Nyegenye.
He directed him to serve his papers on Orwoba before October 11 when the court will give further directions.
Prior to the lawsuit, Nyegenye through his legal team had asked Orwoba to retract her statements published on social media.
Failure to do so, he warned he would take legal action against her.
Orwoba is serving six months ban from the House for alleged gross misconduct.
Last week, the House approved a report by the House Powers and Privileges Committee that accused her of making unsubstantiated allegations of sexual favours by the Clerk.
“Senator Orwoba made unsubstantiated allegations that there were instances of pursuit of sexual favours in Parliament by posting various messages on Senate Business WhatsApp,” the report by the committee chaired by Speaker Amason Kingi states.
Last week, the Clerk, through Wamae and Allen Advocates gave Orwoba until Friday last week to delete and retract all defamatory statements that she has made against him or he sues.
“We have instructions to require from you and we hereby do as a matter of urgency, the immediate cessation by yourself of the making and publication of the false and defamatory allegations against our client,” the letter states.
The clerk demanded immediate removal from all social medial platforms run by Orwoba and internet websites and social and other publicly accessible fora.
