Court Review: KCAA in court for Weston Hotel land as plea to drop Sh357m case against KRA chair is dismissed
Corridors of justice this week had a series of high profile cases that were handled by various courts in the country.
Here are some of the cases dealt with:
Order for audit of late tycoon Nginyo's estate
The High Court ordered the estate of the late Kiambu tycoon Nginyo Kariuki to be subjected to a forensic audit following claims of meddling by a section of the beneficiaries.
Issuing the orders, Lady Justice Abigail Mshila said the audit will assist the court in arriving at a determination.
This is following accusations made by one of the daughters, Brenda Nyambura Kiragu, against her siblings.
The beneficiaries are to propose names of forensic auditors within 14 days and make proposals for payment of fees for the forensic audit and the auditor.
The case will be mentioned on January 16, 2024 to confirm compliance.
Nginyo died on February 24, 2022.
Threats at High Court at Eldoret
Four years ago, Mustafa Idd killed Vera Beauty College student Emma Wanyota at Moi’s Bridge in Uasin Gishu County.
The court heard and convicted him last month and is expected to impose the sentence on November 27.
On Wednesday, the lady's angry mother told the court that she is willing to 'slaughter and eat' the man.
Speaking during the pre-sentencing hearing, Beatrice Wanyota pleaded with the court to inflict the same pain of brutal death against Idd.
She said if the man is released, she would do everything possible "to kill him and chew his remains like a chewing gum.
On September 30, 2019, Emma’s body was found at her home, badly mutilated and with missing parts.
It is alleged that she was raped before her legs were chopped off.
In a testimony after the incident, the victim’s sister Sheila Wanyota said Mustafa was well-known to them and he was Emma’s ex-boyfriend.
KCAA after Weston Hotel land
The Kenya Civil Aviation Authority (KCAA) has filed a fresh application at the High Court to intervene as it renews its bid to reclaim the land upon which Weston Hotel stands.
KCAA told the Environment and Lands Courts (ELC) that it has been two years since Weston obtained orders suspending the case to pursue an appeal.
It added that this has made no progress at all.
Officer detained for 14 days in al Shabaab recruitment case
The Garsen Court detained a police officer accused of recruiting youth to the Al-Shabaab terror group for 14 more days pending the conclusion of investigations.
Constable Hiribae Dima Hamisi appeared before Senior Resident Magistrate Geoffrey Kimanga on Friday where the court heard that there is credible information that he actively participated in the recruitment and radicalisation of youth in Tana River County.
The youths are said to have disappeared to join terror groups.
Court declines to suspend graft case against KRA chairperson
On Wednesday, the Anti-Corruption Court declined an application to terminate a graft case against KRA Board Chairperson Anthony Mwaura and his wife, Rose Njeri.
The Office of the Director of Public Prosecutions had filed the application before Milimani Law Courts Magistrate Eunice Nyutu.
In 2019, Mwaura was charged alongside former Nairobi Governor Mike Sonko and 15 others over an alleged embezzlement of Sh357 million from Nairobi City County.
The court dismissed the application on grounds of lacking merit and expressed frustration over the ODPP's incessant adjournments via text and email.
Nyutu gave the prosecution one more chance to produce witnesses against the accused persons.
“This court will not allow itself to be dragged down that slippery slope. In as much as the DPP has the discretion to withdraw a case at any stage, such discretion must be exercised judiciously. He cannot purport to cherry-pick accused persons for review of their cases simply because they "requested" him for review,” the court documents read.
