Man found guilty of killing college student jailed for 45 years

The High Court has sentenced Mustafa Idd to 45 years in prison for the murder of Emma Wanyota, a student at Vera Beauty College.

The incident happened four years ago. 

High Court Judge Richard Nyakundi said Mustafa deserved the death penalty but because it was active in Kenya he had opted to issue the 45 years jail term.

"This was a very heinous killing in which you were driven by malice, hatred and brutality," the judge said.

The judge said evidence in court indicated that Mustafa brutally dismembered the body of the deceased in a shocking manner.

He said although Mustafa had through his lawyer said he was remorseful in mitigation, the aggravating factors in the matter outweighed the mitigation.

"What you did shows you do not value life and the jail term will give you time to reflect on your actions," the judge said.

Mustafa was found guilty of murder by Justice Nyakundi.

The mother of the deceased Beatrice Wanyota had asked for a maximum sentence against Mustafa.

Last week she wept before the court as she narrated how Mustafa raided her home and killed her daughter brutally.

"He ransacked my house searching even my pants for what I have never known. I am a widow and it was so painful that he killed my daughter most brutally," she said.

Wanyota claimed Mustafa and his relatives had been threatening her family in and out of court.

After the sentence was passed she said she was satisfied with the 45-year jail term although she would have wished for a more severe sentence.

But the lawyer for the accused, Rioba Omboto, asked the court for leniency arguing that Mustafa was remorseful for the offence.

He said Mustafa committed the offence after being radicalised through religious teachings but he has since reformed.

Nyakundi had last month ruled that Mustafa was responsible for the murder of the 21-year-old student. 

Emma’s body was found at her home, badly mutilated and with missing parts.

It is alleged that she was raped before her legs were chopped off on September 30, 2019.

In a testimony after the incident, the victim’s sister Sheila Wanyota said Mustafa was well-known to them and he was Emma’s ex-boyfriend.

"After parting ways with my sister in August, he had been threatening her and all the male contacts in her phonebook," she said. 

"It's painful for us as a family but we thank God that at last some justice has been done," she said.
