In Summary

  • The court declared the unconstitutionality of the housing levy fund.
  • The only way out of it is to go to the Constitution and make provisions that rectify the mischief.
Kitui Senator Enock Wambua during an interview in Parliament on Monday, September 4, 2023.

First, the question that President William Ruto should be asked is: Is he keen on keeping his campaign promise that he would put money in the pockets of hustlers or he’s busy taking away money from their pockets?

He has to deal with that contradiction himself.

He’s the one who made that promise. He was even lyrical about it during the campaigns.

But time has come now for him to fulfil the promise that he would put money in the pockets of hustlers and that hustlers will have a say in his government.

But now what we are seeing is the hustlers are being injured – worse off than the way they were before Ruto become the President.

Ruto should tell Kenyans that apart from Sh500 that he has given to people as a loan – Hustler Fund – what other money has he put in the pockets of these hustlers?

Second, the court declared the unconstitutionality of the housing levy fund.

The only way out of it is to go to the Constitution and make provisions that rectify the mischief that the courts have identified.

You don’t make something constitutional by bringing in an ordinary legislation.

Third and, lastly, what I don’t understand is this:

During public participation for the Finance Bill, 2023, more than 99 per cent of the people who gave their views said that this fund is a burden on them and on every Kenyan and, so, they don’t want it.

We, in the minority side, have told him that, away from politics, this fund is not even practical. You are promising people houses from where?

People are contributing to a scheme to get these houses from where?

The church has told him, this fund just leave it.

The court has told him this is unconstitutional. Who does he want to hear? Who else does he want to hear from to know that this thing is unpopular and people don’t want it?
