Advocates as front-row seat stakeholders in the Judiciary and matters good governance will fearlessly and tirelessly risk our all to defend the rule of law, the Constitution 2010 and the independence of the Judiciary.

All Kenyans of good will must stand up and speak out against overzealous state officials, whatever their cadre and title, who think they can override the reasonable checks and balances on their powers imposed by the Constitution.

This is why as the Law Society of Kenya, which is statutorily mandated to defend the Constitution and the rule law, we have decided that we will mobilise our members to stage peaceful street purple ribbon protests next week to express our displeasure with the arrogant, unlawful and incendiary order by the head of state to his officers to disregard legitimate court orders.

We take note of the government’s increasing dereliction of their commitment to uphold the rule of law and obey court orders.

The sustained attacks against the courts for doing their work, and remarks by government politicians urging the President to disregard court orders on account of the presidential immunity he enjoys, are a confirmation that the people of Kenya stand to suffer the brunt of a government running rogue.

We will remain steadfast in protecting our Judiciary, as it proves the only arm of government that places public interest ahead of political factors.

We urge all Kenyans to stand firm and keep faith in the work our Judiciary does.

The law society will stay diligent in holding all Judicial officers accountable, and we will do so objectively, not to settle political scores.

This is not to say there are no elements in the Judiciary who are not only corrupt but also actively facilitating corrupt dealings.

We will keep calling them out, but that must be done in a manner that promotes the Constitution and rule of law, rather than blanket condemnation and undermining confidence in the Judiciary and seeking to intimidate judges to make decisions in one way or another.

All, including President William Ruto and his officers, have a robustly independent but accountable Judiciary as the only hope.
