The Sh30 million fraud case facing former Kenya Pipeline MD Charles Tanui and two others is expected to proceed today.

Tanui was in 2020 charged with irregular payment of Sh30 million for the supply of three transformers when he was in office.

He was charged alongside Elias Maina who was the chief manager in charge of the technical department and Josphat Sirima who was the chief engineer.

The three were accused of abuse of office but they denied the charges before Anti-Corruption chief magistrate Douglas Ogoti.

They were then released on Sh700,000 bail each or an alternative Sh2 million bond and one surety.

Establishment of NG-CDF Act

A constitutional petition challenging the establishment of the National Government Constituency Development Fund Act has also been listed for hearing today.

The case was filed in 2016. Activist Wanjiru Gikonyo challenged the fund, which was formed after the old CDF Act was quashed by the High Court.

He wanted the court to declare NGCDF unconstitutional because it creates a third layer of governance that is not in the Constitution.

However, Members of Parliament led by Eldama Ravine’s Moses Lessonet had argued that the National Government Constituency Development Fund (NGCDF) is nationwide and benefits a lot of people, especially those at the grassroots level.

They further argued that should the kitty be scrapped, the socio-economic rights of wananchi would be violated.

Since the filing of the case, some amendments have been made to the Act making the entire petition lose significance as the underlying issues have been dealt with through the amendments.
