Former President Mwai Kibaki's estate inheritance dispute is coming up for hearing of application to have his body exhumed for DNA tests.

Those seeking a share of the late Kibaki's empire are Jacob Ocholla who claims to be the former president's firstborn son and a woman codenamed JNL.

The two objectors are demanding that Kibaki's body be exhumed to allow for DNA tests insisting it is the only way to confirm he was their biological father.

Ocholla claims no existing male siblings can assist in getting the right DNA to ascertain that he is Kibaki's son. Ocholla claims he is Kibaki's first-born child.

Kibaki had listed his four children Judy Wanjiku, Jimmy Kibaki, David Kagai and Anthony Githinji as heirs to his multimillion estate.

The children have since opposed attempts to exhume Kibaki's body saying subjecting the body to DNA testing will violate their privacy.

Judy who swore the affidavit on behalf of her siblings also said the order to exhume Kibaki's remains cannot be whimsically granted since he was buried following a state funeral and that the interment was a matter of national and international importance which public funds funded.

Inquest into the death of Tecra Muigai proceeds for hearing

Separately, the inquest into the death of Tecra Muigai is to proceed for a hearing.

Tecra died on May 2, 2020, at Nairobi Hospital.

She allegedly fell down steep stairs at a house in Lamu.

Her mother Tabitha Karanja testified that she suspected Omar Lali could have had a hand in her daughter’s death because she might have refused to continue financing him.

She testified that it was Lali’s greed that caused her daughter’s death.

The Nakuru Senator was recalled in court after Lali made the application in a bid to cross-examine her regarding her testimony in court saying when she testified, he was absent and was also not represented.

At the time the matter was being handled by Senior Principal Magistrate Zainab Abdul.

She was transferred to another station.

Tabitha said it was not normal for Tecra to be transferring huge amounts of money ‘to a 60-year-old man’.

She admitted that she didn’t know why Tecra was sending the money but it was not a normal occurrence.

“In our culture, men send the money, not the other way round. Not usual for an older man to be receiving huge amounts of money from a young girl,” she said.

Tecra was 29 years old when she met her death.
