Terrorism charges against Sonko, two others dropped

The court approved the DPP's move to withdraw the 2021 case.

Former Nairobi Governor Mike Sonko has been freed from terrorism charges after  Kahawa West Law Court approved the move by the DPP to withdraw the case.

Kahawa Law Court principal magistrate Daniel Kiage on Wednesday marked the matter as withdrawn after the prosecution applied to have the 2021 case withdrawn. 

"I have considered the application by the prosecution and I hereby mark the matter as withdrawn under section 87A of the CPC," the magistrate ruled.

The defence had applied that the cash bail deposited be returned to the accused persons.

In the case, Sonko had been charged alongside two others, namely Clifford Ochieng Ouko and Benjamin Onyango Odhiambo.

Sonko had been charged that with others not before the court.

The charge sheet indicated that he knowingly recruited unknown persons to commit or participate in the commission of a terrorist act in contravention of the act.

He was accused of allegedly committing the offence on or before January 1, 2021, at an unknown place within the country.

The other charge against Sonko stated that he was found in possession of property for the commission of a terrorist act, contrary to Section 6 of the Prevention of Terrorism Act, 2012.

The charge sheet said that on January 31, 2021, in Athi River, within Machakos County, he had in his possession military attire for the commission or facilitation of a terrorist act.

Ouko’s charge sheet read:

“On February 3, 2021, while in Komarock Phase 2 within Nairobi County, you were found in possession of a military combat short of North Atlantic Treaty Organization (NATO), a Super Sick military combat shirt and a pair of military desert camouflage uniform for the commission of a terrorist act.”

The charge against Odhiambo stated:

“On or before February 3, 2021, at an unknown place within the Republic of Kenya, had in your possession a military camouflage jacket for the commission or facilitation of a terrorist act.”Ouko and Odhiambo were out on a cash bail of Sh200,000 each. Sonko was freed on a cash bail of Sh500,000.
