In Courts: Court to rule on State bid to detain Mudavadi aide for 14 days

The state sought to have them detained for 114 days pending completion of investigations.

The director of the press service in the office of the Prime Cabinet Secretary  Salim Swaleh will today know whether he will be held behind bars for 14 days as a court rules on his bail application.

Swaleh was arrested alongside five other individuals on Sunday and is being held at Capitol police station on claims of conspiracy to commit a felony.

Investigators Monday told Milimani principal magistrate Ben Mark Ekhubi that the suspects are being probed on accusations of attempting to defraud two foreigners of Sh5.5 million on claims that they would help them get tenders to build stadiums.

The state sought to have them detained for 114 days pending completion of investigations.

That application was however opposed by defence lawyers Danstan Omari, Shadrack Wambui and Sam Nyaberi who argued there was no compelling evidence to deny the suspects bail.

Those arrested alongside Swaleh are Michael Otieno Japolo, Terry Kemunto, Daniel Omondi Gogo, John Musundi Wabomba and James William Makoha.

The magistrate is expected to rule on the application this morning.

Elsewhere, the High Court will today sentence six convicts who were found guilty of murdering former Juja MP George Thuo.

Justice Roselyn Korir is expected to deliver the sentences at 11 am after the matter was last week adjourned because the judge was committed elsewhere.

The convicts are Paul Wainaina Boiyo alias Sheki, Thuo’s aide Christopher Lumbazio Andika alias Lumba, DJs Andrew Karanja Wainaina and Samuel Kuria Ngugi alias Visi, Esther Ndinda Mulinge, a waiter, and a patron Ruth Watahi Irungu alias Atlanta.

Thuo's widow Judy last month urged the court to ensure the crime doesn't go unpunished.

She said the former lawmaker did not die a natural death and the court should consider that when imposing its sentence on the six.

"I know there is forgiveness and I know this is a just court... but it is the life and blood of a human being. It shouldn't be that somebody can kill someone and be set free," Judy said.

A doctor' report concluded that Thuo's cause of death was hemorrhagic gastroenteritis due to poisoning.
