Mathare MP Anthony Oluoch has been freed from incitement to violence case by a Nairobi court.

This is after the prosecution told Milimani senior principal magistrate Robinson Ondieki that they did not intend to continue with the trial of the case.

"Having considered the application by the DPP to withdraw the matter, I hereby mark this case as withdrawn under section 87A of the CPC," the magistrate ruled.

In 2023, Oluoch and two Nairobi MCAs were in July charged with conspiracy to commit subversive activities against the law by inciting members of the public to protest.

The other two are Makongeni MCA Peter Imwatok and Kitusuru MCA Alvin Orlando.

They all denied that with others not before the court, they mobilised and incited the public to commit subversive activities on July 12, 2023, in Nairobi.

Two weeks ago, the matter came up for hearing but the prosecutors asked for more time to peruse the file, informing the court of the state's intentions to withdraw the charges.

Early in June, Embakasi East MP Babu Owino was also discharged from the same offences.
