Petitioner wants top officials found guilty of contempt in AFA restructuring

A contempt of court petition has been filed at the Employment and Labour Relations court seeking to have some officials of the Agricultural Food Authority and the Public Service Commission punished for allegedly disobeying court order.

The petitioner wants the officials and a PS found culpable of the offence for undertaking the restructuring works at the Authority arguing that the court had issued a stop order on the same.

The applicant argues that by allegedly disobeying court order, the Rule of Law, adjudicatory authority and the sanctity of the Honourable Court, and the Judiciary of Kenya is being put to great ridicule and is under attack.

"The respondents proceeded with the preparation and organisation restructuring of the AFA devoid of any public participation and with total disregard to the proceedings of this court and provisions of law and envisage under section 11 of AFA act hence countermanding the order of the court and bestowing upon themselves Authority equivalent of the honourable court," the court papers say.

The petitioner now wants the officials brought before the court to show cause why they should not be held accountable for the offence and a declaration be issued to find the respondents unsuitable to hold office.

Also sought, are orders requiring an OCS to arrest the respondents and the cost of the cost of the suit imposed on the respondents.
