Acting IG Gilbert Masengeli is expected in court this morning to explain why he should not be punished for disobeying court orders.

The judge last week pushed the matter to today after court proceedings were hijacked by activists.

If Masengeli fails to turn up, this will be the fourth time he will have snubbed court summons.

Mugambi had on August 28 directed the Inspector General of police, DPP, AG, DCI and National Intelligence Service to immediately disclose the whereabouts of Bob Micheni, Jamil Longton and Aslam Longton to the Law Society of Kenya which has filed the case in court.

This order has not been complied with. That is why the court has been summoning Masengeli to court.

LSK filed the case stating that Several reports have been made that the three were abducted by armed police officers, taken away and held incommunicado at undisclosed locations.

According to the court documents, the three through their social media platforms sensitized the youth to come out in large numbers and to advocate for the rejection of the finance bill in totality.

They also allegedly asked Kenyans to actively participate in the countrywide protests agitating for change in the country.

"It was then that the respondents through armed police officers started abducting them," says LSK.

LSK says Bob was abducted on August 19 2024 at around 10:40 pm by masked men on his way home from a matatu commonly known as the Rembo shuttle in the Kasina area.

The other two were abducted on August 19 2024 at around 2:00 p.m. while leaving their house at Kitengela.

They were allegedly bundled into a white Subaru that drove off to an unknown destination and are yet to be released to date.

"None of these persons has been charged with any known offence before any court of law in Kenya," says LSK

Separately, a Nairobi court will today decide on the inquest into the death of tycoon Tob Cohen.

The DPP 2022 withdrew the murder charges against Cohen's widow Sarah Wairimu and her co-accused and subsequently registered the matter as an inquest.

They issued a press statement explaining the decision they took saying several things emerged during the reviewing of the file which were unclear leading to the withdrawal of the murder charge.

At the time, Jacinta Nyamosi from the DPP office said in 2020 they wrote two letters directing the investigating team to cover 35 areas of investigation which were not been covered.

“The statements recorded by the police indicate that several cops in civilian clothes visited the compound of the late Cohen and the identity of the said officers remains undisclosed,” Nyamosi said.

The prosecution also said that they even directed that the sub-county police commander Gigiri be interrogated on his interaction and relationship with Sarah but that was not done.

Cohen’s body was found close to two months after his disappearance on September 13, 2019, in a septic tank within his palatial home in Kitusuru.
