Relief for Gachagua advisers as court blocks arrest, prosecution

Deputy President Rigathi Gachagua's staff have obtained an order stopping their arrest and subsequent prosecution over allegations of financing the Gen Z protests that took place in the country in June this year.

Justice Lawrence Mugambi issued the order following an application filed by Gachagua's political advisor Ngunjiri Wambugu, George Theuri  (youth advisor) and Pius Mugene (private secretary).

"Pending the hearing and determination of this application, the court hereby issued a conservatory order restraining the respondents from arresting, detaining or prosecuting them from the allegations raised in this petition," Justice Mugambi ruled.

The respondents in the case have been listed as the Director of Criminal Investigations, the Inspector General of Police, the DPP and the Attorney General.

The Judge in certifying the matter as urgent directed the application by the three served on the respondents by close of business Friday.

The trio faulted the state for going to the extent of desiring to prosecute them on "trumped up charges".

"It was the president who was on record addressing the public and informing Kenyans on investigations conducted regarding the financiers," they argued.

The three said the probe was able to establish who these people were.

"The communication of the president whose word is binding on the final findings of the investigative authorities vindicates us of any wrongdoing in the allegations," said Ngunjiri.

They said their names were not mentioned in the statement.

They roped in the Deputy President while they claimed: "the intended prosecution is a mere witch-hunt and an arm twisting manoeuvre which is the fruit of a poisoned tree".

The case will be mentioned on October 15.
