A Magistrates court has recommended murder charges be instituted against Omar Lali over the death of his ex-girlfriend Keroche heiress Tecra Muigai.
This is after senior principal magistrate Zainab Abdul found Lali criminally culpable over her death.
"It is my finding that Omar Lali is criminally culpable for the murder of Tecra. Therefore, this court orders the Director of Public Prosecutions (DPP) to recommend charges under Article 157 of the constitution," said Abdul.
A Magistrates court has recommended murder charges be instituted against Omar Lali over the death of his late ex-girlfriend Keroche heiress Tecra Muigai.
This is after senior principal magistrate Zainab Abdul found Lali criminally culpable over her death.
"It is my finding that Omar Lali is criminally culpable for the murder of Tecra. Therefore, this court orders the DPP to recommend charges under article 157 of the constitution," said Abdul.
The magistrate in determining Lali was responsible for her death said claims of Tecra falling from the stairs could not have caused such severe brain damage as evidenced in the post-mortem reports.
The court also took into consideration inconsistencies between Lali's account of events of the material day and the findings in the medical and postmortem reports.
The DPP had in 2020 made a move to prosecute Lali but later dropped the charges and applied for an open inquest.
Tecra was the daughter of Keroche Breweries chairman Joseph Karanja and the CEO, Tabitha Karanja.
She died on May 2, 2020, at Nairobi Hospital after allegedly falling down steep stairs at a house in Lamu.
Tecra's mother who was a witness in the case testified saying she suspected Omar Lali could have had a hand in her daughter’s death because she might have refused to continue financing him.
She said it was Lali’s greed that caused her daughter’s death.
The Nakuru Senator said it was not normal for Tecra to transfer huge amounts of money ‘to a 60-year-old man’.
She admitted that she didn’t know why Tecra was sending the money but it was not a normal occurrence.
“In our culture, men send the money, not the other way round. Not usual for an older man to be receiving huge amounts of money from a young girl,” she said.
Tecra was 29-years-old when she met her death.
