Former Wiper Party Deputy Secretary General, Youth Affairs, Felix Mambo Nduli has been charged with publishing false information on Machakos Governor Wavinya Ndeticontrary to Section 23 of the Computer Misuse and Cybercrimes Act NO 5 OF 2018.

Nduli according to the prosecution, on diverse dates at unknown places within the Republic of Kenya with intent to cause panic, chaos or violence among citizens of the Republic of Kenya jointly with others not before court published in social media to wit “Only Wavinya and her son can substantiate bro. Mimi na wewe tuko Kathangaita wao wanakula Raha UK” a fact he knew to be false.

He pleaded not guilty to the charge and was released on Sh200,000 cash bail or Sh300,000 bond and surety of a similar amount.

Nduli appeared before Chief Magistrate Barbara Ojoo of Mavoko Law Courts on Monday.

He was arraigned on Monday following his arrest last Thursday in the case where Governor Ndeti is the complainant.

The Directorate of Criminal Investigations officers attached to the Athi River police station on October 31, 2024, arrested the suspect after he allegedly ignored several police summons before he was released on Sh10,000 police bail pending arraignment.

Both Ndeti and her eldest son Charles Oduwole are listed among the witnesses in the case alongside others according to court documents seen by the Star.

Nduli through his lawyer requested copies of statements and any documentary evidence on the case.

“The substance of the charge and every element thereof has been stated by the court to the accused person in the language that he understands, who is asked whether he admits or denies the truth of the charge, he said it wasn’t true," Chief Magistrate Ojoo said in her ruling

"The court therefore releases him on Sh200,000 cash bail or Sh300, 000 bond and surety of a similar amount."

The mention has been slated for November 18, 2024.
