A petition challenging the appointment of Raila Odinga's key allies into President William Ruto's Cabinet has been withdrawn.
Justice Chacha Mwita marked the matter as withdrawn after the petitioner Julius Ogogoh told the court that his case had already been overtaken by events.
This is after John Mbadi, Hassan Joho, Opiyo Wandayi and Wycliffe Oparanya were already appointed as Cabinet Secretaries in their respective dockets.
"My client wishes to withdraw the case as the matter has been overtaken by events following the assumption of office by the four," said the advocate representing Ogogoh.
Ogogoh the executive director of the Commission for Human Rights filed the case arguing that their appointment has a negative effect as it will disable the opposition from discharging its oversight role on the operation of the government.
He argued that the opposition has a constitutional and parliamentary duty to offer checks and balances and in particular to oversight the actions of the government.
“Their appointment conflicts with their constitutional duty bestowed upon the opposition party by Kenyans and the Constitution to oversight the government and to provide checks and balances," said Ogogoh.
He explained that their inclusion is insensitive and unnecessary to the economic times the country is undergoing since it will automatically occasion by-elections in their respective places.
