The High Court in Kibera will from 11am today hear the application to release Sarah Wairimu on bond or bail pending the hearing and determination of a case in which she is charged with the murder of her husband Tob Cohen.
Wairimu was last week charged afresh with the 2019 killing in Nairobi.
She was presented before Kibera High Court Judge Diana Kavedza where she denied the charge.
The court had put the plea taking on hold to allow the prosecution to avail a mental assessment report taken in 2019 that showed she is fit to stand trial.
The report retrieved from Mathare Referral Hospital was availed and the plea was subsequently taken.
The prosecution told the court they would be opposing her release on bail. They sought more time to file an affidavit to support their application.
The Judge subsequently directed that the state file and serve the respective affidavit within 24 hours.
The defence is to respond within 12 hours. Each party was allocated twenty minutes each to submit the bail application with the hearing set for 11 am today.
Elsewhere at the anti-corruption magistrate court, the case against Embakasi North MP James Gakuya is coming up for hearing.
Gakuya and his brother Patrick Wairungi were charged alongside 12 other co-accused in August 2018 with fraudulent acquisition of public property, conflict of interest, conspiracy to defraud and wilful failure to adhere to procurement and disposal laws.
The accused are charged with fraudulent acquisition of Sh39,858,050 Constituency Development Fund cash that was allegedly used for fictitious road construction contracts.
Gakuya and his brother Patrick Wairungi are accused of receiving Sh19,691,772 for supplying nothing.
Court documents also show that Wairungi's Mabaks Enterprises was paid Sh11,691,771 for the construction of Muoroto AP road.
The suspects allegedly received the money between July 8 and November 20, 2015.
