
A cybercrime officer from the DCI displayed before the High Court in Eldoret a CCTV footage showing how a lawyer was attacked by his colleague using a broken beer bottle at a party leading to his death.
Inspector Daniel Kieni produced and played the CCTV footage before Justice Robert Wananda who is hearing a murder case against Lawyer Abel Mogaka.
The accused is alleged to have killed his colleague Calvin Musachi Ngaira during a commotion at a party they attended with several other colleagues.
The party was hosted by another lawyer at his house located in the Annex area near the Moi University School of Law along the Eldoret-Nakuru highway.
Mogaka has denied the offence which he is said to have committed on May 18, 2019. He is out on a Sh1 million bond as the hearing of the case continues.
Inspector Kieni told the court that as shown in the CCTV footage, the accused person used a broken bottle to stab the deceased on the left side of his neck during a fight outside the apartment where they were attending the party.
The two had engaged in a quarrel during the party leading to the fight.
The late Ngaira had practised for barely three months in Eldoret town before he met his death.

Kieni dismissed claims by the defence that the deceased was the aggressor during the confrontation and also told the court that the accused used force to stab the deceased.
“The CCTV footage clearly shows the accused person holding something in his right hand while running after the slain lawyer and stabbing him on the left side of his neck even after he (deceased) had retreated from the fight,” said Kieni.
After the incident, Ngaira who was bleeding profusely was rushed to the Mediheal Hospital about three kilometers away and he later succumbed to the injuries at the facility.
According to Kieni, moments later, the accused is seen holding a glass as he walks out of the house while being followed by the slain lawyer before a fight ensues between the two.
Kieni said he retrieved the footage at the scene while in the company of the investigating officer in the case Sergeant Sophia Hassan who is based at Langas police station in Eldoret.
The footage shows the occurrence time of the tragic incident was between 1708 hours to 1715 hours on May 18, 2029.
Brenda Oduor who is leading the prosecution in the case filed an application to recall the first witness Edith Chebet to shed some light on the events during the incident.
Chebet and the investigating officer will close the prosecution case.
Justice Wanada directed that Chebet be recalled and that the defence will be allowed to cross-examine the two.
