The High Court is expected to hear an application filed by Former Governor Wa Irias's wife, Jane Mbuthia, challenging her prosecution in the Sh351m graft case.
Mbuthia, Top Image Media Consultancy Limited, and David Maina filed the application a week ago seeking to bar the Ethics and Anti-corruption Commission from conducting further investigations and gathering evidence into the challenged procurement process at the County Government of Murang'a.
The three have already been charged before the Anticorruption Court but they want the High Court to suspend any further proceedings in th case.
They allege that the Ethics and Anti-corruption Commission lacks the mandate to probe procurement processes and any alleged occurrences of procurement irregularities.
"The EACC while lacking the mandate, has illegally obtained various evidence, letters and materials that they wish to rely on in our intended flawed prosecution," the three claim.
They allege that the evidence being relied on before the Anticorruption court was allegedly illegally obtained and in violation of their fundamental rights including right to equal protection and fair administrative action.
